Autopsy of Corrupt Costa Rica CAFTA Arbitration Ruling

Mr. Alvaro Diaz, a Costa Rican,who wrote his autopsy Report, used the following statement by a US Federal Judge as the standard to Judge the Aribrators Ruling.

CHICAGO, ILLINOIS, UNITED STATES, October 3, 2018 / — "A US Federal Judge recently said, “Our ruling needs to be accurate and correct because they affect peoples’ lives. The Ruling must be clearly explained so that both parties, even the losing party, understands how we came to our decision and that it was a just and fair Judgment.”

However, according to Alvaro Diaz, in his report. "Autopsy of a Corrupt Costa Rica CAFTA Arbitration Ruling" he said this, "The Arbitration ruling, in this instant case, clearly shows, by the Arbitrators own words, that inadmissible evidence was proffered by the State. Instead of being disallowed, these hearsay attorney’s assertions were treated as factual evidence and embraced by the arbitration panel in order to rule against the Claimants. In this Arbitration proceeding the attorneys for Costa Rica made the incredulous argument that the claimant, David Aven, duped all the of the key environmental agencies (SETENA, MIANE, SINCA and INTA) into granting permits for the Las Olas project. These were conclusory statements not supported with factual evidence."

Mr. Alvaro continued, "The Costa Rica State made a decision not to obtain direct testimony from any of the above mentioned key Environmental agencies. This was in light of the fact that these very same agencies did a number of on-site inspections of the property, writing a number of reports, all of which said there were no wetlands on the Las Olas project site. Furthermore, at the hearing, Mr. Aven testified, under oath, to the fact that he did not dupe these agencies and asked the panel where was SETENA’s statement saying that he duped them. Instead, the panel just ignored Mr. Aven’s statement and question, made under oath. Without any direct testimony from any of the key Environmental agencies, the Arbitrators accepted the conclusory hearsay statements by the State’s attorneys and disregarded all of the key agencies EV permits and inspection reports all stating there were no wetlands."

By way of example, Mr. Diaz used the Arbitrators to clearly expose their corrupt ruling in saying this, "In Paragraph 558 of their ruling the arbitrators said:" “If Claimants had submitted in their D1 Application the information relating to the existence of potential wetlands as described in the so-called Protti Report, it is more likely than not that SETENA would have exercised its powers and verify the conditions on site prior to issuing the Environmental Viability and perhaps SETENA would have subject the Las Olas Project to some limitations in its development to protect the potential wetlands identified.

"Again, SETENA makes an appearance in the Arbitrators Ruling without ever providing any direct evidence. This is probably one of the more, alarming and revealing speculative statements made by the arbitrators that shows a biased and corrupt ruling."

"In looking at Arbitrators words and their use of, “potential wetlands, more likely than not, perhaps SETENA would, likely have”. The entire Paragraph is made up of speculative words, not words of facts and evidence. The arbitrators end the Paragraph with a definitive speculative statement, “but the Parties would not be involved in this case.” That statement is an unknowing prognostication by the arbitrators, since it wasn’t based on any facts or evidence. Did the Arbitrators have a crystal ball allowing them to look into the future to see that “the Parties would not be involved in this case” at a future date?” This is just more non-factual conclusory hearsay statements on the part of the Arbitrators that has no place in a legal ruling. Coupled with all the other speculations throughout their ruling, it presents “prima facie” evidence revealing their ruling was bias and corrupt".

Alvaro Continues, "What is clear as a bell, is that it was incumbent upon the Costa Rican State to obtain witness statements from SETENA, confirming all of the speculative allegations and assertions being made by the Costa Rican Attorneys against the Claimants. It was incumbent on the Arbitrators to tell Costa Rica they were derelict in their duty for not getting those important witness statements from key Government agencies, therefore the State could not now proffer hearsay evidence on behalf of those agencies."

Alvaro concludes by saying this, "Did the Judges/Arbitrators in this case, by their own words in 768 Paragraphs in 239 pages even remotely parallel the above standard? Quite the opposite, it appears the arbitrators actions are darkened by both their conduct and their words. Their darkened conduct brings embarrassment and condemnation upon our entire legal community and specifically on International arbitrators who are expected to render just and fair Rulings and not biased and corrupt ones." While the arbitrators each made $650,000 for their corrupt ruling, the US Investors lost $90,000,000 (90 Mlllion USD) to Costa Rica's organized crime family. Every year Costa Rican's and foreigners lose billions of dollars via Government and non-Government corruption. Rather than Siqueiros, Nikken, and Baker standing as white Knights against this massive corruption, they instead were seduced and ate from its poisoned tree. As part of their Machiavellian scheme, the Arbitrators ordered Claimants to pay Costa Rica $1,000,000 USD to defray the money that Costa Rica had to pay for their favorable ruling. The corruption between the Costa Rica State and the arbitrators can be clearly seen throughout their corrupt Arbitration ruling against the US Investors.

However a real smoking gun for this corruption can also be seen when Costa Rica "RECENTLY" refused to condemn Venezuela for human rights violations, along with Canada, Argentina, Chile, Colombia, Paraguay and Peru. Was it just a mere coincidence that Costa Rica's arbitrator, Pedro Nikken, was from Venezuela? Is it evidence of a payback to Venezuela for their help in obtaining a favorable ruling?

The vice- minister told eTN that part of a new campaign to attract tourists is to promote "The 5 Magical towns of Zacatecas." These are communities that, because they have preserved their original architecture, traditions, and customs, have been found worthy of this distinction.

1. Jerez de García de Salinas

This peaceful municipality was designated in 2007 as the first Magical Town of Zacatecas.

Its old houses with spacious courtyards and eclectic architecture contrast with the provincial atmosphere that is enjoyed while touring its colonial streets.

Among the most emblematic places of Jerez are:

• The Kiosk of the Main Square
• The Hinojosa Theater
• The Parish of the Immaculate Conception
• The Sanctuary of the Virgen de la Soledad

What about the food?

The minister told eTN: "Zacatecas is known for great food, and this is also different from the rest of Mexico. As one of the largest producers of silver, it is a mining city. Visitors should try the locally -grown and fried chili.

"Zacatecas' has a distinctive gastronomy, including wine and Corona, the largest brewery in Mexico, and our soil is full of minerals which gives this unique taste to everything."

Here are some of the dishes Zacatecas is known for:

• Caldo or Cocido — these are general terms for stews, but in Zacatecas the traditional recipe consists of three kinds of meat (beef, pig and chicken), string beans, garbanzos, small squash, sweetcorn, a bit of rice, onion, garlic and saffron. Upon serving, the vegetables are separated from the stew, and then the dishes are eaten with a great deal of chili sauce
• Gorditas — biscuit-like packages of cooked cornmeal, lard and salt, stuffed with beanpaste and chili
• Condoches –gorditas made with sweetcorn mixed with cinnamon, milk, sugar and vanilla, cooked atop corn leaves
• Birria — small chunks of goat or sheep, or both, smothered in chili sauce, garlic, salt, thyme, cumin, black pepper and cinnamon
• Menudo — cow rumen stewed with chilies

What about sweets?

• Capirotada — white bread fried with slices of bread alternating with cheese, peanuts, potato, nuts and preserved biznaga cactus, all bathed in honey or unrefined brown sugar
• Queso de Tuna — candy made from prickly pear cactus, sometimes prepared with nuts
• Camote — the word camote means sweet potato; when a sweet is being referred to, it's a candied sweet- potato cut into bars and wrapped in paper
• Biznaga — candied cactus of the genus Mammillaria
• Gordita de Cuajada or Gordita de Horno — a gordita filled with goat-milk cheese that is ground with corn, milk, sugar and cinnamon.

eTN asked the minister why their focus is on European visitors and not so much on visitors from the United States.

She said: "We welcome visitors from the U.S., and there is a lot of cultural and family connection between the U.S. and our state. American tourists without families ties to Mexico seemed to be more interested in beaches. Zacatecas is all about culture and to get a feeling to be in a typical historic Mexican city.

Americans also seemed to be less aware of the geographics in Mexico when it comes to travel advisories. This part of Mexico is still untouched and unexplored in so many ways, and it's safe."

"It makes a lot of sense to us to focus on European guests. Europeans have longer holidays, and we realize Zacatecas is not a single destination. Europeans have the time to enjoy Mexico's beaches, the capital, and spend some addtional days in Zacatecas, which is so different than the rest of our country.Europeans enjoy the historic regions and our city center, which has been made a UNESCO World Heritage site."

While attending Top Resa, the Vice Minister spoke with major tour operators including the big companies like TUI/ Thomas Cook, and there was great interest in exploring this hidden jewel of Mexico, she said. In France 59% of all bookings to the area are made by tour operators.

"Zacatecas is a happy place, it's a city of art, and not only because the regions have many cantinas that stay open very late," Minister Ibarra emphasized. "We're planning to attend WTM in London and ITB in Berlin also for the first time, and my team is working hard to get the cooperation of other Mexican regions to work with us and include us when promoting the country.

"We already started reaching out in Asia, but not yet to China. We're excited for our future tourism plans!"

Perhaps the message is to visit Zacatecas before mass tourism gets a hold of the region. Zacatecas has all the ingredients for it.

Analysis Shows How the NYC Subway System Can Derail Your Hearing Health

Millions of commuters in NYC know the subway system can be noisy, but just how loud is it? Hearing Health Foundation (HHF) has quantified the danger to hearing.

NEW YORK, NY, UNITED STATES, October 2, 2018 / — Millions of commuters using the New York City subway system know it can be noisy, but just how loud is it? Hearing Health Foundation (HHF), the nation's largest charity funder of hearing and balance research, set out to measure the danger that the NYC Metropolitan Transit Authority (MTA) subway system presents to riders and employees.

We found that the system significantly breaches the threshold of what is safe for our ears. To protect hearing, both the U.S. Environmental Protection Agency and the World Health Organization recommend an average exposure limit of 70 decibels (dB) over the course of 24 hours. But what we measured exceeds that limit: Our samples show the average noise levels on all subway platforms and on all subway rides (inside subway trains) is between 72.5 and 76.5 dB and between 74.1 and 75.8 dB, respectively. And, with maximum readings actually as high as 119 dB on platforms and 120 dB on rides—based on actual recorded data within the sample—the NYC subway is likely an auditory minefield. Using our data’s sample averages, we determined ranges as to what the actual averages are on all subway platforms and rides through the MTA system. Based on the data, we are 99 confident about our results.

From January to August 2018, three data collectors used Decibel Meter Pro, a smartphone app on iPhones and an iPad to collect 120 samples from platforms and rides. All 60 platform samples were equally represented at five minutes each. The 60 ride samples were assigned random recording lengths from 10 to 30 minutes. Samples on Saturday and Sunday or between 11 p.m. and 4:45 a.m. on any day were excluded. Random sampling was utilized as much as possible to help ensure generalizability on behalf of all platforms and rides.

The analysis examined potential harm to hearing from loud noises on subway platforms and loud noises during subway rides. For platform noise, the main variable is the number of trains that pass; for subway ride noise, the main variable is the number of local stations the train passes. We also investigated the number of seconds the subway noise level reached 75 dB or higher.
When measuring subway rides, we noted train travels between Manhattan and another borough or vice versa; whether a train runs above ground; whether the sample was collected during rush hour; and whether a local train ever becomes an express train, with fewer stops.

The statistical method of multiple regression was used to predict dangerous noise exposure on both platforms and rides. We can predict that each train that enters or leaves a platform will expose a rider’s ears to 16.53 seconds of noise at 75 dB or higher. For example, if a rider waits at a platform where two trains come and go before their train arrives, that would be a predicted exposure of 82.65 additional seconds of noise at 75 dB or higher.

We can also predict that each subway stop that is passed will expose a rider’s ears to 36.06 seconds of noise of 75 dB or higher. For example, if a rider passes 10 local train stops on their trip, the predicted exposure of noise at 75 dB or higher is 360.60 additional seconds—or 6.01 additional minutes.

HHF’s recommendation for commuters, MTA staff, and platform retailers such as newsstand operators is simple: Wear ear protection. MTA staff and platform retailers are at elevated risk given the hours they spend underground and on the trains. The tendency for many commuters to block noise by raising the volume of their headphones is not a helpful approach and could, in fact, damage hearing even more.

The subway is merely only one of many sources of daily noise. “Noise-induced hearing loss can result from a single, sudden noise event and from constant exposure to loud noises that has a cumulative effect (not unlike sun exposure) and can lead to related negative health effects when unknown and untreated,” says Lauren McGrath, HHF’s marketing manager.

The MTA appears aware of the issue of subway noise. The newly built Second Avenue subway line uses effective noise-reduction measures such as “low vibration tracks and sound absorbing panels.” We hope the MTA will continue to use these quieter, low vibration tracks when making subway and station upgrades, especially since they are more cost-effective than traditional wooden tracks.

Chinese tech giant Ant Financial on Monday set out major expansion plans to make the UK one of its biggest international markets for mobile payments.

HONG KONG, HONG KONG, HONG KONG, October 2, 2018 / — The move comes ahead of its anticipated blockbuster stock market listing: Ant – the payment affiliate of China’s leading tech group Alibaba – already has 700 million users in China alone using its digital wallet app to hail taxis, make doctor appointments and buy investments as well as its core business of online and bricks-and-mortar payments.

Now at the start of China’s Golden Week national holiday season when wealthy Chinese tourists flock to the capital’s shops, restaurants and hotels, Alipay’s European boss Roland Palmer said that London is the focus of Alipay’s international expansion.

“We’ve signed up thousands of merchants – in the last 6 months, we’ve seen a 60% growth in the UK – activating most of Chinatown’s stores, supermarkets and restaurants, plus the London Eye, Sealife and other Merlin Entertainment venues. Alipay is enabling the surging numbers of Chinese consumers who are now travelling abroad to spend their money in UK stores.”

"We have a long waiting list of High Street brands and restaurant chains who want to use Alipay to access Chinese tourists’ spend.” Current retailers include Harrods, Selfridges, Holland and Barrett, Heathrow Airport and the shops of Bicester Village.

Some 337,000 Chinese tourists flocked to the UK last year, a 30% rise on the previous 12 months – spending £694 million during their stays. Chinese visitors to the UK spend more than three times the average for foreign tourists.

But Chinese travelers in Europe are only allowed to bring 10,000 euros in cash. “In one city that can be swallowed up with spending on luxury goods,” Palmer said. “Alipay means that they can keep the spend going, directly from their mobile bank account in China.”

Palmer said Alipay does not yet have plans to take on existing mobile wallet players here, such as the High Street banks and Apple Pay, to grow as a UK payment platform. “We’re entering the UK market, but focusing on Chinese spend,” he said. “That alone is a big opportunity for now – In Europe, UK user numbers and merchant numbers are punching above their weight with Chinese spending on Alipay – the UK is doing better than the European average.”

The move follows Ant Financial’s $14 billion fundariser in June, which gave it a valuation in excess of $150 billion, and funds to ramp up globalisation plans.

In China, 40 million brick-and-mortar merchants accept Alipay. Its UK ramp-up comes weeks after Alibaba’s co-founder, Jack Ma, announced he will step down from his post next September.

This move is part of a larger expansion plan Alibaba, specifically Ant Financial in this instance, is adopting to target European countries as their global role out of fintech services continues.
